Terms & Conditions
These Terms govern use of www.nipponvehicles.com and all stock sales, auction sourcing, export document support, shipping support, vehicle, machinery and parts transactions handled by Nippon Vehicles.
1. Definitions
- Company / We / Us / Our: Nippon Vehicles / 日本自動車合同会社 / NIPPON JIDOSHA GODO GAISHA.
- Website: www.nipponvehicles.com and related website pages or forms.
- Buyer / Customer / User: Any person or company using our website, requesting a quotation, submitting an inquiry, buying a vehicle or using our services.
- Services: Stock sales, auction sourcing, vehicle export support, C&F quotation, document handling, shipping coordination, auto parts inquiry and customer support.
- Order: A confirmed purchase or auction request for a vehicle, machinery, part or related service.
- Incoterms: International trade terms such as FOB, CFR, CIF and other terms stated on the invoice or quotation.
2. Scope & Changes
These Terms apply to all visits, inquiries, quotations, orders, payments, exports, shipping support and after-sales communication involving Nippon Vehicles.
We may update these Terms from time to time by posting a new version on this page. Continued use of the website or services after publication means the updated Terms are accepted.
3. Eligibility & Import Compliance
The Buyer is responsible for confirming that the vehicle, machinery or parts can be legally imported, registered and used in the destination country before purchase.
- Import rules, age limits, emissions rules, inspection requirements and taxes differ by country.
- Destination port charges, customs duty, local taxes, registration, compliance, inspection and delivery charges are the Buyer’s responsibility unless stated in writing.
- We may refuse or cancel an order if export, sanctions, payment, identity or destination compliance creates risk.
4. Account, KYC & Anti-Fraud
For fraud prevention, payment safety and export compliance, we may request identity or company verification from the Buyer.
5. Product Information & Used Vehicle Condition
Most vehicles, machinery and parts offered by Nippon Vehicles are used. They are sold on an as-is / where-is basis unless a written warranty is specifically provided.
- Photos, videos, auction sheets, mileage, grades, repair history, options and descriptions may include third-party information and may not be guaranteed.
- Minor scratches, dents, paint fading, rust, wear, stains, noise, old batteries, tire wear and age-related issues may exist in used vehicles.
- Vehicle condition can change during storage, transport, inspection, loading, sea shipping or destination handling.
- The Buyer should ask questions and request inspection before payment/shipping if condition is important.
6. Quotations, Pricing, Taxes & Errors
- Quotations are valid only for the stated period. If no period is stated, a quotation may change without notice due to exchange rate, freight, stock status or supplier price changes.
- FOB, C&F, CFR or CIF pricing includes only the items clearly written on the invoice or quotation.
- Destination taxes, duties, port charges, customs clearance, local registration, inspection, agent fees and local delivery are not included unless stated in writing.
- We reserve the right to correct typographical errors, system errors, calculation errors or incorrect price displays.
7. Order Process, Stock Reservation & Deposits
An order is considered confirmed only after we issue a written confirmation or invoice and payment/deposit is received according to the invoice terms.
- Stock vehicles may be sold to another buyer until reservation/payment is confirmed.
- Auction sourcing orders may require a deposit before bidding.
- Deposits are generally non-refundable after we commit costs, reserve stock, place bids, arrange inspection or book shipping on behalf of the Buyer.
8. Payment Terms
- Unless otherwise agreed in writing, payment must be made by bank transfer or approved payment method to the official account/details provided by Nippon Vehicles.
- The Buyer is responsible for all bank charges, intermediary bank charges, currency conversion charges and remittance costs.
- Vehicle ownership/title and documents may not be released until full cleared payment is received.
- Late payment may cause reservation cancellation, storage fees, shipping delay, rebooking fees or other extra charges.
9. Inspections & Pre-Shipment Options
Upon request and at the Buyer’s cost, we may arrange third-party inspection or export inspection such as JEVIC, JAAI or other available inspection agencies depending on destination requirements.
- Inspection availability, pass/fail results and standards are controlled by the inspection agency, not Nippon Vehicles.
- Any repair, cleaning, reinspection or special requirement needed to pass inspection may create extra cost.
- If the Buyer declines inspection, the Buyer accepts the risk of buying based on available information.
10. Shipping, Risk Transfer & Delivery
Shipping method, destination port and trade terms are based on the invoice/quotation and available vessel schedules.
- For FOB/CFR/CIF shipments, risk normally transfers according to the applicable Incoterms and shipping conditions.
- Vessel schedules, ETD/ETA and transshipment routes are estimates and may change without notice.
- Delays may happen because of port congestion, weather, carrier operation, customs checks, inspection delays, holidays or force majeure events.
- After arrival, the Buyer is responsible for import clearance, duties, taxes, port charges, local inspection, registration and local delivery.
11. Export Documents
Depending on the order and shipment type, we may provide commercial invoice, export/deregistration certificate, bill of lading or surrendered B/L, inspection certificate and other available shipping/export documents.
- Special documents must be requested before shipment.
- Courier fees, amendment fees, reissue fees or document correction costs may be charged if caused by late or incorrect Buyer information.
- The Buyer must provide accurate consignee, notify party, address, phone number and port details before document processing.
12. Storage, Demurrage & Additional Charges
If the Buyer delays payment, delays shipping instructions, fails to collect documents, fails to clear the vehicle at destination or provides incorrect details, any storage, demurrage, detention, rebooking, amendment, courier, port or penalty charges are the Buyer’s responsibility.
13. Cancellation & Refunds
- Cancellation before shipment is possible only if we have not committed costs or obligations.
- Costs already paid or committed on behalf of the Buyer may be deducted from any refundable amount.
- After successful auction bidding, vehicle purchase, port delivery, inspection booking or shipment, cancellation may not be possible.
- Refunds, if approved, will be returned by a method chosen by Nippon Vehicles after deducting applicable bank fees and costs.
14. No Returns for Used Vehicles & Parts
Due to international export, shipping costs, used condition, customs procedures and registration rules, used vehicles, machinery and parts are generally not returnable after purchase or shipment unless explicitly agreed in writing.
15. Warranty Disclaimer
Unless a written warranty is expressly provided by Nippon Vehicles, all used vehicles, machinery and parts are sold as-is without warranty of condition, mileage, fitness, merchantability, repair history, future performance or compatibility with destination country rules.
16. Limitation of Liability
To the maximum extent permitted by law, Nippon Vehicles is not liable for indirect, incidental, special, punitive or consequential losses including loss of profit, business loss, import refusal, shipping delay, port charges, registration failure, customs issues or destination compliance problems.
Our total liability, if any, shall not exceed the amount paid to Nippon Vehicles for the specific product or service that caused the claim.
17. Sanctions, Export Controls & Prohibited Use
We comply with applicable Japanese and international export control, sanctions, anti-money laundering and anti-fraud rules. We may refuse, cancel or report a transaction if required by law or if we believe the transaction involves prohibited persons, countries, uses or suspicious activity.
18. Website Content, Copyright & Scraping
All website content, photos, text, logos, code, page designs, vehicle data and documents are owned by or licensed to Nippon Vehicles unless otherwise stated.
- You may not copy, scrape, download, reproduce, republish or commercially use our website content without written permission.
- Automated scraping, bot harvesting, mass copying and misuse of vehicle data or images are prohibited.
19. Privacy & Personal Data
Personal information is handled according to our Privacy Policy. Customer data may be used for quotations, order processing, export documents, shipping communication, payment confirmation, fraud prevention and legal compliance.
20. Governing Law & Dispute Resolution
These Terms are governed by the laws of Japan. The parties should first attempt to resolve any dispute through good-faith communication. If court action is required, the dispute shall be handled by the court with jurisdiction over Nippon Vehicles’ principal office, unless mandatory law requires otherwise.
